ADALAT’s Civil Law Expert STTAs will work up to 75 working days to implement the assigned activities in Afghanistan during Year 2 of the ADALAT program, which ends on 30 September, 2018. The Civil law Expert will coordinate activities with, and be assisted by the ADALAT Supreme Court judicial training team, ADALAT’s Sub Purpose 1 Judicial Training Advisor.
CONTRACT DURATION: Each of these three Short Term Positions is for up to 75 working days.
Specifically, the Civil law Experts will undertake the following tasks:
STTA # 1 Job Descriptions:
Review general provisions and all the agreement parts of civil law and provide analytical explanation for them.
Review all legal incidents articles and provide analytical explanations.
Collect legal materials which are useful for developing the civil law manual.
Research on civil law and analyze the articles in accordance with the new legal perspectives.
Meet judges at Civil and if necessary in Public Rights Diwans and consult with them and receive their ideas on complicated civil law articles and subjects.
Report regularly from given tasks to ADALAT judicial team.
Any other relevant task given by judicial team.
STTA # 2 Job Descriptions:
Review general provisions and all the natural obligations parts of civil law and provide analytical explanation for them. (Chapter 3, 1st season, Civil Law V. II)
Review all property enforcement articles and provide analytical explanations. (2nd season, 3rd chapter, Civil Law V. II)
Review all articles on (enforcement through compensation, and guaranteeing moneylenders' rights) and provide analytical explanations. (4th and 5th seasons, chapter 3, Civil Law V. II).
Collect legal materials which are useful for developing the civil law manual.
Research on civil law and analyze the articles in accordance with the new legal perspectives.
Meet judges at Civil and if necessary in Public Rights Diwans and consult with them and receive their ideas on complicated civil law articles and subjects.
Report regularly the given tasks to ADALAT judicial team.
Any other relevant task given by judicial team.
STTA #3 Job Descriptions:
Review specified contracts of civil law and provide analytical explanation for them. (Ch.1, season 1, Civil Law V. III)
Review all sell subject and provide analytical explanations. (Ch.1, season 1, Civil Law V. III)
Review all articles on (obligations of seller and all other articles till ninth debate) and provide analytical explanations. (Ch 1, Season 1, Civil Law V. III).
Collect legal materials which are useful for developing the civil law manual.
Research on civil law and analyze the articles in accordance with the new legal perspectives.
Meet judges at Civil and if necessary in Public Rights Diwans and consult with them and receive their ideas on complicated civil law articles and subjects.
Report regularly the given tasks to ADALAT judicial team.
Any other relevant task given by judicial team.
Having BA in Law or sharia law. Master’s degree or above holder is preferable.
5- 7 years of experience in the related job or with judiciary.
Prior experience working as Professor, judge, prosecutor or defense lawyer is preferred
Experience with Afghanistan judicial system, education and training programs desirable
Excellent written and spoken Dari language skills.
Ability to use computer programs (MS Office) and access to internet is desirable.
