Job Summary

The scope of duties of the Contracts Management Officer (CMO) management will cover of all types of contracts and agreements under the NATEJA project. This will involve preparing and managing all aspects of the various contracts, including drafting, on-going contract management and oversight, completion and disposition of the contract file.

Duties & Responsibilities

a. Maintaining a database specifying contract description, price, deliverables, payment terms and other relevant information required for management of contractual obligations;
b. Preparing a Checklist for meeting important requirements of the contract and making sure that all the necessary requirements are met in a timely manner;
c. Maintaining contract database in accordance with the World Bank requirements;
d. Providing requested data to the World Bank on any contractual aspect;
e. Conveying essential contractual features/requirements/obligations to the relevant project officials;
f. Monitoring the performance of the contract against the planned and agreed timelines;
g. Providing progress reports and updates to the Senior Procurement Specialists and/ or other senior managers on the performance status of the contracts;
h. Assisting the Senior Procurement Specialists and/ or other senior managers in initiating notices to correct contract performance in cases where it is lagging behind the schedule;
i. Assisting the Senior Procurement Specialists and/ or other senior managers in issuing termination of contracts which fail to perform according to the contract obligations;
j. Assisting the Senior Procurement Specialists and/ or other senior managers in issuing change orders and/or modifications to the contracts where necessary and agreed and approved;
k. Receiving advance payment Bank Guarantees and processing advance payment requests;
l. Verifying performance Bonds/Bank Guarantees and advance payment Guarantees from the issuing banks or other entities;
m. Arranging licenses, permits, tax exemptions to be provided to the Contractors as required by the contract;
n. Receiving progress payment requests, reviews their compliance to the terms of payment, deducts retention money, if any, and forwards them to the Finance Manager for further processing;
o. Following up with Finance and other departments to expedite payments to the contractors;
p. Assisting audit teams to review the files;
q. Helping procurement personnel to maintain all contract files in the proper manner;
r. Performing any other task assigned by the Procurement Manager and/or the Program Director.

Job Requirements

a. Bachelor degree in business, economics, or other related field;
b. 4 years’ experience with Government Development projects, donor funded projects or any national or international NGO in the management of goods, works and services contracts and procurement;
c. Sound knowledge and understanding of procurement law and procurement rules and procedures for public procurement in Afghanistan;
d. Sound knowledge and understanding of World Bank procurement guidelines and procedures;
e. Sound knowledge and understanding of the Government’s administrative systems as well as the Government’s clearance and approval procedures applicable to procurement;
f. Sound judgment and interpretative skill for dealing with procurement-related issues and documents including, specifically, (i) bidding documents (ii) bid evaluation documentation and procedures and (iii), contract documents.
g. Effective communication and interpersonal skills including (i) a full working knowledge of English (ii) fluency in one national language and good reading, writing, listening and speaking skill in the other and (iii), the ability to interact and coordinate with NSDP staff, contractors, Government officials, consultants and the World Bank staff.
