Job Summary

Under the general direction and guidance of the Deputy Minister (Policy), Ministry of Finance of Islamic Republic of Afghanistan, International Legal and Procurement Consultant develops and supports PPU activities, on the areas of Legal/regulatory, policy making to function properly.

S/he will serve as focal point for and coordinates the legal and regulatory activities of PPU to work properly. S/He will liaise with the related stakeholders in preparing procurement legal standard documents including Procurement Manual, and legal provisions for promoting the usage of electronic systems in public procurement (Afghanistan Procurement MIS in particular). S/He will periodically interact with PPU, and procuring entities/LMs. S/He will provide support to the Director of PPU in interacting with L/Ms and related departments.

Ministry of Finance needs an International Legal and procurement Individual Consultant to support legal and regulatory, Private Sector Development and Economic Governance in a consistent basis over the course of the designing programs proposals and implementation phase. The individual selected will perform the following functions in particular:

Duties & Responsibilities

The International Consultant under the general supervision of Deputy Minister (Policy) and direct supervision of Head of PPU, is requested to produce the following deliverables:


Draft a Procurement Manual on Public Procurement of Afghanistan

Analyze the current public procurement legal framework and related documents to develop new legal provisions and/or modify the current provisions in order to promote the usage of electronic systems (Procurement MIS/ e-GP) in lms and procuring entities.

Undertake consultative missions and meeting with stakeholders to determine needs, identify areas of cooperation and support and inform them regarding priorities and programs;

Takes active participation in responding/ resolving the complicated legal cases being referred to PPU for Appeal and Review in light of the PPL.

Collect and analyze information on economic studies on procurement, comparisons and future projection;

Set a strategy for public private sector partnership in public procurement

Assist in developing capacity programs and training materials, including Training of Trainers (TOT), to enhance the level of Trainers Capacity.

Assist PPU in setting a comprehensive strategy in carrying out capacity certification assessment of LMs for standalone procurement.

Tailor Procurement Standard Documents, Procedures, and guidelines produced by PPU for their better quality and implementation.

With the assistance of IT/PMIS staff, enhance the quality of the website and PMIS to share lessons learnt, share best practices, share legal references, post international conventions, post training dates, learning events, national and international conferences.

Provide support in establishing an effective linkage between PPU and the LMs and to enhance visibility and sustainability of the program with the possibility in setting the ground for a government policy framework that will support a sustainable model the E-Government Procurement (E-GP).

Education & Experience:

Minimum Master’s Degree or equivalent in Law.

Experience:

Minimum 10 years Demonstrated experience in Procurement

Language Requirements:
Excellent English communication skills (Reading, writing and speaking).

Ability to lead formulation and monitoring of management projects

Solid knowledge in financial resources and human resources management, contract, asset and procurement, information and communication technology, general administration
