The legal advisor supports the Legal services Directorate providing timely guidance and advice on all issues of legal services at the Ministry of Mines and Petroleum including bill drafting (Amendments)to Mineral Law, regulations and procedures, commercial, contract, governance, dispute resolution, and other relevant laws and regulations of Afghanistan.
Mining Legal adviser needs to have excellent skills in reasoning and evaluation, must possess good analytical skills and have good command over oral and written communication skills. He/she must have practical idea of judgment and also be able to work in large and diverse team. He/she must well versed with the Hydrocarbon laws and regulations and have the ability to adapt new environment with much comfort and accuracy.
The Legal advisor is also required to be very well organize and need to possess strong management skills to finish assigned task within an estimated time period. There are several responsibilities of a legal advisor that includes supporting and helping the Legal Services Directorate with all the jobs of the Ministry of Mines and Petroleum related to the laws, regulations, contracts, tender process, bid-evaluation process and contract analysis. Mining Legal advisor has the full authority to give legal assistance on laws and regulations, functionality of current legal framework, legal mining regime, policies, and contracts administration procedure, biding documents, tender process, risk management plan and dispute resolutions. If needed he/she would also work with different departments of the Ministry of Mines and Petroleum on certain projects like contract administration, contract analysis, taxes, contract reviews, upgrading mining legal frame work of the MoMP.
Most important duty is to provide legal support, guide and advice to the Legal Services Directorate.
Suggest and advice on various legal-mining matters like legal drafting, contractual issues, commercial contracts, biding document, tender process, evaluation procedure, dispute resolution, regulatory, grievance procedure and governance.
Ensure that legal support is regularly available with regard to any mining activities of the Ministry of Mines and Petroleum.
Ensure that the Legal Services Directorate is properly briefed on any Mining legal issues.
Must work together with other members of MoMP departments on amendment process of the Minerals Law, regulations and procedures.
Legal Advisor need to coordinate and work on drafting process of the MoMP procedures.
Must ensure that the Mining legal documents are drafted, reviewed effectively and interpreted well
Must take appropriate steps on different types of mining legal issues.
To be able to handle external as well as internal legal resources skills and specifications
Under direct supervision of the Legal Services Director, Coordinate legal issues with Ministry of Justice, parliament and other legal entities in order to help to MoMP get the legal documents immediately passed by the cabinet and the parliament
Professional qualifications must include a degree in Law or other relevant disciplines.
A minimum of 3 years of experience in a relevant field;
Must have a knowledge of Afghan Mining sector (Mineral Laws and Regulations).
Must be expose strong practical judgment
Must be able to work in team that is multi-disciplinary
Ability to work efficiently and meet requirements within time frame
Fluency in spoken and written Dari, English and Pashto
Ability to work effectively in a multi-ethnic and multi-cultural environment
A sound knowledge of Microsoft Office applications
Proven ability in establishing good network across a range of government and public agencies
Excellent communication and interpersonal skills, particularly on governmental levels
Must possess strong analytical skills
