The Legal Officer is responsible for follow up of all the cases in the court, Attorney’s General and other legal department. He/she is responsible to cooperate with all the loan officers wherein there are delinquent clients. He/she is responsible for keeping a track sheet of all the clients whom are delinquent and he should report daily and weekly to the Head of Legal.
General Objectives:
o Provide Legal counseling to all departments of TOM.
o Make sure that the organization follows Afghan Laws.
o Draft all agreements, contracts, MOUs and modifications and send them to Head of Legal to review before they are signed.
o Field work, follow up of all cases once they are handed over from Operation department to legal.
o Points of contract for contract dispute.
Follow up of Legal cases:
o Follow legal causes related to delinquent loans with local courts.
o To ensure follow up of legal cases with employees and other companies.
Procedures and documentations:
o Supervise that all loan Contracts are disbursed according to procedures and are in accordance with legal requirements.
o To assist developing manuals and other official documents in accordance with law of the Islamic Republic of Afghanistan.
o Advice TOM on best practices and content of employment contracts and labor/personnel related matters.
o Any other duty will assign by concern supervisor
o Bachelor in law, member of the bar association, and or equivalent experience.
o 2-3 year experience.
o Must have Afghanistan Independent Bar Association (AIBA) license.
o Knowledge of the Afghan legal systems, laws and procedures, as well as Sharia principles.
o Good legal research capabilities and analytical and skills.
o Good legal research capabilities and analytical and skills.
o Fluency in English with strong written and verbal communication skills; knowledge of Pashto /Dari is an asset;
o Excellent analytical, communication and interpersonal skills, and experience in legal issue management;
o Ability to work in a challenging environment with poor infrastructure and human capacities and difficult security conditions;
o Highly motivated with a strong interest in development and social issues.
o Advanced computer skills.
